O CONSELHO TUTELAR E O ENSINO DE FILOSOFIA NA DEFESA DE UMA EDUCAÇÃO CRÍTICA

Abstract

This dissertation aims to analyze how practices of censorship and ideological persecution in the school environment can constitute a violation of educational rights. These practices are linked to the imposition of an ultra-conservative bias that undermines fundamental principles of education, especially the pluralism of ideas and citizen formation. Based on this premise, I argue that the censorship and persecution of teachers who seek to comply with the legal provisions of the Federal Constitution and other norms guiding Brazilian educational policy constitute a violation of students' rights. Given this scenario, the involvement of the Conselho Tutelar is justified, as it is the body responsible for protecting and guaranteeing the rights of children and adolescents, acting in defense of students and, consequently, of educators. The investigation stems from my academic and professional trajectory as a Teacher, Educator, and Conselheiro Tutelar (“Guardianship Councilor”) in the city of Niterói/RJ, Brazil. Drawing on these experiences and creating space for authors from the most diverse political and philosophical spectrums to engage with this theme, such as Demerval Saviani, Marilena Chauí, Silvio Gallo, Martha Nussbaum, Michael Apple e Louis Althusser, I sought to understand the effects these ultra-conservative movements have had on Brazilian educational policies, highlighting the removal of the mandatory status of the Philosophy discipline from the school curriculum and its consequences for the guarantee of educational rights. As a Educational Product, I present a Handbook, authored by me, intended to guide the school community on the role of the Conselho Tutelar and the procedures to be followed in situations of suspected or confirmed violence against children and adolescents. The material provides suggestions, guidance, and referrals aimed at strengthening the role of schools in defending the rights of children and youth.

Esta dissertação tem como objetivo principal analisar como as práticas de censura e perseguição ideológica no ambiente escolar podem configurar violação de direitos educacionais. Essas práticas se articulam com a imposição de um viés ultraconservador que fragiliza princípios fundamentais da educação, especialmente o pluralismo de ideias e a formação cidadã. Com base nessa premissa, compreendo que a censura e perseguição a professores que buscam cumprir os dispositivos legais previstos na Constituição Federal e demais normas que orientam a política educacional brasileira, configuram violação dos direitos dos estudantes. Diante desse cenário, o acionamento do Conselho Tutelar se justifica, uma vez que se trata do órgão responsável pela proteção e garantia dos direitos de crianças e adolescentes, atuando em defesa dos educandos e, por consequência, dos educadores. A investigação parte da minha trajetória acadêmica e profissional como Professor, Educador e Conselheiro Tutelar na cidade de Niterói/RJ. Tomando como base essas vivências e abrindo espaço para autores dos mais diferentes espectros políticos e filosóficos que dialogam com esta temática, tais como Demerval Saviani, Marilena Chauí, Silvio Gallo, Martha Nussbaum, Michael Apple e Louis Althusser, busquei compreender os efeitos que esses movimentos ultraconservadores tiveram sobre as políticas educacionais brasileiras, destacando o fim da obrigatoriedade da Disciplina de Filosofia no currículo escolar e suas consequências para a garantia dos direitos educacionais. Como Produto Educacional, apresento um Manual, de minha autoria, destinado a orientar a comunidade escolar sobre o papel do Conselho Tutelar e os procedimentos a serem seguidos diante de situações de suspeita ou confirmação de violência contra crianças e adolescentes. O material oferece sugestões, orientações e encaminhamentos que visam fortalecer a atuação das escolas na defesa dos direitos infantojuvenis.
